Terms and Conditions

Introduction

These Terms and Conditions ("Terms") set out the legal agreement between you ("the Trainee") and Train To Become A Driving Instructor (TTBADI) in relation to your instructor training course.

By making payment for your selected training course via bank transfer, you confirm that you have read, understood, and accepted these Terms in full.

You will also receive these Terms via DocuSign for electronic signature. Payment alone constitutes acceptance, even if a signed copy has not yet been returned.

Upon successful completion of the course, Calm Driving may offer you the opportunity to join its franchise as a driving instructor, subject to DVSA approval. You are under no obligation to accept this offer and may pursue your career independently.

Section 1 – Course Fees and Payment Structure

1.1 Course Fees

The total price of your training depends on the package selected. All packages require an upfront payment which covers:

• Course setup
• Training pack, including books, learning materials, and your first training module

1.2 Payment Plan

You may choose to make a single payment or to pay via a three-month instalment plan.

Training includes:

• In-car training
• Assignment assessments
• Online activities requiring trainer evaluation

The instalment plan consists of:

• Month 1: A higher initial instalment covering setup, books, and materials delivered via Royal Mail
• Months 2 and 3: Equal instalments completing the full course fee

Only a three-month consecutive payment plan is accepted.

1.3 Refund Policy – "Refund TTBADI Policy"

If you choose to terminate your course, entitlement to a refund depends on:

• The length of time you have been enrolled; and
• The amount of training completed

Training is delivered in sessions of approximately 2 to 3 hours. Each session includes:

• In-car training
• Private practice (PP)
• Online assignments and study pages
• Trainer time spent marking and assessing assignments outside sessions

If you withdraw:

• £250 is charged per training session attended, including private practice evaluations
• A £350 non-refundable setup and administration fee applies (covering course setup, books, and materials)

Refund Example

Course price: £3,000

Includes:

• £350 non-refundable administration fee
• Access to the online Part 1 course
• Materials delivered via Royal Mail

If you complete four private practice sessions and four in-car sessions:

• 4 sessions × £250 = £1,000
• Total retained: £1,350

Potential refund: £1,650

Section 2 – Eligibility and DVSA Requirements

To qualify as a driving instructor, you must:

• Pass a DBS check
• Be deemed a "fit and proper person" by the DVSA

If you commence training without your DBS check or PRN number, you do so at your own risk. The Refund TTBADI Policy will still apply.

DVSA considerations include:

• Criminal convictions
• DBS results
• Motoring and non-motoring cautions, convictions, or fixed penalties
• Medical fitness and eyesight standards

By accepting these Terms, you confirm that:

• You are medically fit to drive
• Your eyesight meets DVSA standards
• You will notify TTBADI immediately of any change affecting your driving ability

Section 3 – Training Conditions and Course Progress

3.1 Licence Endorsements

If penalty points are added to your licence after training has commenced and you no longer meet DVSA "fit and proper" requirements, training may be terminated. The Refund TTBADI Policy will apply.

3.2 Non-Transferability

Your training course is personal to you and cannot be transferred to another individual.

3.3 Cooling-Off Period

You have a 14-day cooling-off period, unless:

• You access any online course materials; or
• You begin in-car training

Once either occurs, training is deemed to have started and the Refund TTBADI Policy applies.

3.4 Inactivity

If Calm Driving is unable to contact you for 90 days, your account will be marked inactive.

• Training may be resumed unless inactivity exceeds six months
• If registration expires, refunds may be requested where applicable under the Refund TTBADI Policy
• After expiry, the course becomes void

Section 3A – Course Components and DVSA Tests

Part 1 – Theory

Includes:

• Six-month subscription to Driving Test Success Anytime
• Trainer monitoring and online record-keeping
• Face-to-face progress discussions

If Part 1 is not passed within six months, mock test access expires; however, training may continue without access.

Part 2 – Driving Ability

Includes:

• In-car training
• Online learning materials
• Development of driving competence linked to Part 3 teaching standards

Failure of Part 2 three times triggers the Refund TTBADI Policy.

Part 3 – Instructional Ability

Includes:

• A combination of online and in-car training
• Structured role play and coaching scenarios

Failure of Part 3 three times triggers the Refund TTBADI Policy.

DVSA Examination Fees

You must book and pay for all DVSA assessments yourself:

• Part 1: £81 per attempt (unlimited attempts)
• Part 2: £111 per attempt (maximum 3 attempts)
• Part 3: £111 per attempt (maximum 3 attempts)

Section 3B – Trainee Licence and Franchise Opportunity

Upon completion of training, Calm Driving may offer you the opportunity to:

• Apply for a Trainee Driving Instructor (PDI) licence
• Join the Calm Driving franchise

If accepted:

• You must apply for your trainee licence within six months of completing training
• The trainee licence lasts six months

PDIs must complete 20 additional hours of training, which are provided at no extra cost under the All Inclusive Plus package.

Completion of training does not guarantee acceptance into the Calm Driving franchise.

Training Location and Time Limits

• All training begins at the trainer's location in Poole, Dorset
• Training is not offered elsewhere
• Part 2 and Part 3 training must be completed within 12 months of the first course payment
• Any unused training after this period is forfeited

Lesson Cancellations

• A minimum of 2 days' notice is required
• Failure to give notice will result in lesson time being deducted from remaining training hours

Section 3C – Additional Training Following Test Failure (Part 2 and Part 3)

3C.1 Free Additional Training Entitlement

If you fail either the ADI Part 2 or Part 3 test, you are entitled to a maximum of six (6) additional hours of training at no extra cost.

3C.2 Flexible Allocation

The six free hours may be:

• Used entirely for Part 2
• Used entirely for Part 3
• Split in any combination between the two

Allocation is agreed with your trainer based on professional assessment.

3C.3 Maximum Limit

The six free hours are the total maximum allowance, regardless of the number of failures.

3C.4 Chargeable Training

Any training beyond the six free hours is chargeable at the standard hourly rate applicable at the time of booking.

3C.5 Non-Refundable and Non-Transferable

The free training hours:

• Have no cash value
• Are non-refundable
• Cannot be transferred to another person or course

3C.6 Time Limits

All free training must be completed within existing course time limits. Unused hours are forfeited.

Section 4 – Complaints and Liability

4.1 Complaints Procedure

If you are dissatisfied with any part of the training:

• Submit a written complaint within 7 days to traintobecomeadrivinginstructor@outlook.com
• Allow 21 days for a response
• If unresolved, you may contact Citizens Advice or the DVSA

4.2 Liability

TTBADI and Calm Driving are not liable for death or personal injury except where caused by:

• Negligence; or
• Breach of these Terms

Nothing in these Terms affects your statutory rights under UK consumer law.

Training Hours Explained – DVSA Compliance

SECTION A – The Required 40 Hours of Initial Training

The DVSA requires completion of 40 hours of structured training, which includes:

• Part 1, Part 2, and Part 3 training
• Assignment completion
• Trainer marking and assessment
• In-car practical sessions

A minimum of:

• 24 hours direct training
• 12 hours assignment completion
• 4 hours trainer marking

This satisfies DVSA ADI 21T requirements.

SECTION B – The Required 20 Hours of Training on a Trainee Licence

Once holding a trainee licence, the DVSA requires 20 additional hours, which may include:

• Teaching real pupils
• Trainer observation
• Lesson observation
• Role play if required
• Assignment completion and marking

This satisfies DVSA ADI 21AT requirements.

• The structure of the 40 hours of initial training
• The structure of the 20 hours of trainee licence training
• Assignment completion and trainer marking forming part of DVSA-required hours
• These Terms and Conditions in full
